1.यह कि उक्त "लाइसेंस परिसर" का मासिक लाइसेंस शुल्क, जो लाइसेंसी द्वारा डिजिटल फॉर्म में भरा गया है, प्रत्येक माह की 10 तारीख तक नकद, चेक अथवा अन्य स्वीकृत माध्यम से अदा किया जाएगा। लाइसेंस शुल्क की रसीद प्राप्त करना लाइसेंसी की जिम्मेदारी होगी तथा बिना रसीद के भुगतान मान्य नहीं माना जाएगा।
2. यह कि लाइसेंसी उक्त "लाइसेंस परिसर" का उपयोग केवल स्वयं के निवास हेतु करेगा तथा बिना लाइसेंसर की पूर्व लिखित अनुमति के किसी अन्य व्यक्ति को सबलेट, हस्तांतरित अथवा उपयोग हेतु नहीं देगा।
3. यदि लाइसेंसी के कारण आस-पड़ोस को असुविधा होती है अथवा लाइसेंस शुल्क का समय पर भुगतान नहीं किया जाता है, तो लाइसेंसर एक माह का लिखित नोटिस देकर इस अनुबंध को समाप्त करने का अधिकार रखेगा।
4.लाइसेंसी को परिसर का पूर्ण एवं विशिष्ट कब्जा (Exclusive Possession) प्रदान नहीं किया गया है तथा परिसर पर अंतिम नियंत्रण एवं अधिकार लाइसेंसर का रहेगा।
5. लाइसेंस अवधि के दौरान परिसर में होने वाली किसी भी दुर्घटना, चोरी अथवा अन्य नुकसान की जिम्मेदारी लाइसेंसी की होगी। ऐसी किसी भी हानि के लिए लाइसेंसर उत्तरदायी नहीं होगा।
6. यदि लाइसेंसी निर्धारित अवधि समाप्त होने के बाद भी परिसर खाली नहीं करता है, तो वह अनधिकृत कब्जाधारी माना जाएगा तथा प्रति दिन ₹2,000 (अक्षरों में दो हजार रुपये मात्र) क्षतिपूर्ति (Damages/Mesne Profits) का भुगतान करने हेतु उत्तरदायी होगा।
7. लाइसेंसी परिसर में किसी भी प्रकार की गैर कानूनी गतिविधि नहीं करेगा। ऐसी किसी गतिविधि के संबंध में उत्पन्न होने वाले समस्त कानूनी दायित्वों के लिए लाइसेंसी स्वयं व्यक्तिगत रूप से जिम्मेदार होगा।
8. यदि लाइसेंसी बिना पूर्व लिखित सूचना दिए परिसर को लगातार 15 (पंद्रह) दिनों तक बंद रखता है, संपर्क में नहीं आता है अथवा लाइसेंस शुल्क का भुगतान नहीं करता है, तो इसे परिसर का स्वैच्छिक परित्याग (Abandonment) माना जा सकेगा।
9. लाइसेंसी केवल लाइसेंसी की हैसियत से परिसर का उपयोग करेगा तथा किसी भी परिस्थिति में स्वयं को किरायेदार सिद्ध करने अथवा किराया नियंत्रण कानूनों के अंतर्गत लाभ प्राप्त करने का दावा नहीं करेगा।
10. लाइसेंसी घोषित करता है कि उसने इस डिजिटल लाइसेंस फॉर्म में उल्लिखित सभी शर्तों को पढ़ लिया है, समझ लिया है तथा उनका पालन करने के लिए बाध्य रहेगा।
11.किसी भी शर्त के उल्लंघन की स्थिति में लाइसेंसर को लाइसेंस समाप्त करने का पूर्ण अधिकार होगा।
12.अतः यह Leave & License Digital Form लाइसेंसर एवं लाइसेंसी के मध्य बिना किसी दबाव, प्रलोभन अथवा अनुचित प्रभाव के, पूर्ण होशोहवास एवं स्वेच्छा से निष्पादित किया जा रहा है, ताकि आवश्यकता पड़ने पर यह प्रमाण के रूप में प्रस्तुत किया जा सके।
13.लाइसेंसी द्वारा दी गई सभी जानकारी एवं दस्तावेज सत्य एवं सही होंगे। गलत जानकारी पाए जाने पर लाइसेंस तत्काल समाप्त किया जा सकता है।
14. लाइसेंसी बिना पूर्व अनुमति के किसी बाहरी व्यक्ति को स्थायी रूप से ठहराने का अधिकार नहीं रखेगा।
15. परिसर में शराब, नशीले पदार्थ, जुआ, हिंसात्मक गतिविधियां अथवा किसी भी प्रकार की अवैध गतिविधि पूर्णतः प्रतिबंधित रहेगी।
16. लाइसेंसी परिसर, फर्नीचर, बिजली के उपकरण या अन्य सामान को किसी प्रकार का नुकसान पहुंचाता है तो उसकी भरपाई लाइसेंसी द्वारा की जाएगी।
17. लाइसेंसी द्वारा डिजिटल फॉर्म में दी गई स्वीकृति (Consent) एवं इलेक्ट्रॉनिक हस्ताक्षर (Electronic Acceptance) को वैध सहमति माना जाएगा।
18. इस अनुबंध से संबंधित किसी भी विवाद का क्षेत्राधिकार केवल उदयपुर (राजस्थान) के सक्षम न्यायालयों को होगा।
19. इस अनुबंध से संबंधित कोई भी सूचना WhatsApp, Email या Registered Mobile Number पर भेजी गई सूचना वैध मानी जाएगी।
20. मैं घोषणा करता/करती हूँ कि मैंने इस Leave & License Digital Form की सभी शर्तें पढ़ ली हैं, समझ ली हैं और अपनी स्वेच्छा से उन्हें स्वीकार करता/करती हूँ। मेरे द्वारा दी गई सभी जानकारी सत्य एवं सही है। "मैं पुष्टि करता/करती हूँ कि मैंने उपरोक्त सभी नियम एवं शर्तें पढ़ ली हैं, उन्हें समझ लिया है और उनसे सहमत हूँ।"
1. The monthly license fee for the said "licensed premises"—as determined by the Licensee in digital form—shall be paid by the 10th of every month via cash, cheque, or any other accepted mode of payment. It shall be the Licensee's responsibility to obtain a receipt for the license fee; any payment made without a receipt shall not be considered valid.
2. The Licensee shall use the said "licensed premises" solely for their own residence and shall not sublet, transfer, or allow any other person to use the premises without the prior written permission of the Licensor.
3. If the Licensee causes inconvenience to the neighborhood or fails to pay the license fee on time, the Licensor reserves the right to terminate this agreement by giving one month's written notice.
4. The Licensee has not been granted exclusive possession of the premises, and the Licensor shall retain ultimate control and authority over the premises.
5. The Licensee shall be responsible for any accident, theft, or other loss occurring on the premises during the license period. The Licensor shall not be liable for any such loss.
6. If the Licensee fails to vacate the premises after the expiry of the stipulated period, they shall be deemed an unauthorized occupant and shall be liable to pay damages (mesne profits) at the rate of ₹2,000 (Rupees Two Thousand only) per day.
7. The Licensee shall not engage in any illegal activity on the premises. The Licensee shall be personally liable for all legal obligations arising from any such activity.
8. If the Licensee keeps the premises closed for 15 (fifteen) consecutive days without prior written notice, remains unreachable, or fails to pay the license fee, it may be treated as a voluntary abandonment of the premises.
9. The Licensee shall use the premises solely in the capacity of a licensee and shall not, under any circumstances, claim the status of a tenant or seek benefits under rent control laws.
10. The Licensee declares that they have read and understood all the terms and conditions mentioned in this digital license form and shall be bound to comply with them.
11. The Licensor shall have the absolute right to terminate the license in the event of a violation of any condition.
12. Accordingly, this Leave & License Digital Form is being executed between the Licensor and the Licensee voluntarily and in a sound state of mind, without any coercion, inducement, or undue influence, so that it may be produced as evidence if required.
13. All information and documents provided by the Licensee shall be true and correct. The license may be terminated immediately if any incorrect information is found.
14. The Licensee shall not have the right to permanently accommodate any outsider without prior permission.
15. Alcohol, narcotics, gambling, violent activities, or any form of illegal activity shall be strictly prohibited on the premises.
16. If the Licensee causes any damage to the premises, furniture, electrical appliances, or other items, the Licensee shall be liable to make good such loss.
17. The consent and electronic acceptance provided by the Licensee in the digital form shall be deemed valid consent.
18. Jurisdiction for any dispute related to this agreement shall lie solely with the competent courts of Udaipur (Rajasthan).
19. Any notice related to this agreement sent via WhatsApp, email, or to the registered mobile number shall be considered valid.
20. I declare that I have read and understood all the terms and conditions of this Leave & License Digital Form and accept them voluntarily. All information provided by me is true and correct. "I confirm that I have read, understood, and agreed to all the above rules and conditions."
